All services are limited to non-legal document preparation assistance based solely on information provided by the user.

You are solely responsible for determining whether your case is appropriate for Small Claims Court under California law.

2. California Jurisdiction Only

Services are limited strictly to:

California Small Claims Court procedures governed by:
California Code of Civil Procedure §§ 116.110–116.950.

We do not provide services for:

  • Federal court matters

  • Other state courts

  • Appeals

  • Complex civil litigation

3. User Responsibility

You represent and warrant that:

  • All information you submit is true and accurate

  • You have legal authority to submit the information

  • You understand we do not verify facts

  • You understand courts may reject documents

We prepare documents strictly as instructed. We do not independently review legal sufficiency.

You assume full responsibility for the outcome of your case.

4. No Guarantee of Results

We make no guarantees, representations, or warranties regarding:

  • Case outcomes

  • Court acceptance

  • Judge decisions

  • Collection of judgment

  • Service of process success

All court decisions are made solely by judicial officers.

5. Limitation of Liability (Maximum Protection Clause)

To the maximum extent permitted under California law:

  • Any indirect, incidental, special, consequential, or punitive damages

  • Lost profits

  • Loss of business

  • Emotional distress

  • Court delays

  • Clerical rejection by court

  • User errors

Total liability, if any, shall not exceed the total amount paid to Biz Technologies for the specific service.

This limitation applies regardless of legal theory (contract, tort, negligence, strict liability, etc.).

6. Indemnification

You agree to indemnify, defend, and hold harmless Biz Technologies, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses arising from:

  • Your misuse of the website

  • False information you provided

  • Violation of these Terms

  • Your legal dispute

This includes attorney’s fees and arbitration costs.

7. Arbitration & Class Action Waiver

All disputes shall be resolved exclusively through binding arbitration in Los Angeles County, California under the Federal Arbitration Act.

You waive:

  • The right to a jury trial

  • The right to participate in a class action

  • The right to consolidated claims

Arbitration shall be conducted by a single neutral arbitrator.

This provision survives termination of services.

8. Refund Policy (Strict Enforcement)

  1. Refund requests within 24 hours and before document preparation may receive a partial refund, excluding service processing fees.

  2. Once document preparation begins, service fees are non-refundable.

  3. Once documents are filed, no refunds are available.

  4. Court filing fees are non-refundable once paid.

  5. Background checks and address searches are non-refundable.

  6. Refunds are not issued based on case outcome.

9. Electronic Consent

By submitting payment or electronically signing documents, you agree that:

  • Electronic signatures are legally binding

  • Digital records are admissible as evidence

  • You waive any claim that electronic execution is invalid

10. Intellectual Property

All content, branding, systems, templates, forms formatting, and website materials are property of Biz Technologies.

Unauthorized reproduction is strictly prohibited.

11. Privacy

We do not sell personal information.

Information may be disclosed:

  • When required by law

  • To courts when filing documents

  • To contracted service providers necessary for processing

Users are responsible for safeguarding their account credentials.

12. Force Majeure

Biz Technologies is not liable for delays caused by:

  • Court closures

  • Government actions

  • System outages

  • Natural disasters

  • Events beyond our reasonable control

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
